Book Review of How to Be a Dynamite Trustee by A. Jeanne Emanuel, Attorney at Law and Thomas A. Emanuel, Professional Feduciary, 2014.This charming little book offers some sound advice for folks who wish to avoid probate as they plan for how their estate will be handled. The format is unusual and quite helpful: Thomas acts as the interlocutor of Jeanne, the lawyer who answers his questions. They draw upon questions they have received from their clients and friends in the whole matter of estate planning. For many folks who are not familiar with some of the terms, the authors provide at timely intervals a summary of the information they have presented. This book is actually a compilation of four individual books, all of which are available for download to your Kindle or similar application.
The authors suggest, even though their book contains much valuable material, that the reader consult with his/her attorney before embarking on setting up a trust, whether it be a revocable or irrevocable trust. The question and answer format allows the authors to cover complicated issues such as the Benefits of a Revocable Living Trust, Durable Power of Attorney, and choosing a Trustee, and a successor Trustee. The book makes clear the balanced responsibilities of the Trustee and his/her duties of impartiality and notifications to the Beneficiaries. The book does, then, cover both legal and ethical issues regarding setting up a Trust and the Responsibilities of a Dynamite Trustee.
The Emanuels also include information that should prove to be helpful as to how to find and submit the proper forms to the IRS and various other accounts the Trustor may have. They give information about the relative size of the estate, suggesting that it is not only large financial estates that need a trust set up, but also smaller estates as well. Terms are explained such as a “Pour Over Will” which this reviewer had not heard of before. There is also a large list of additional resources listed at the end of the book which should prove helpful for those who will pursue setting up a Trust and aid them in finding a professional and competent Trustee or Successor Trustee.

Good book, easy to read. Makes process sound simple. Could use a reference for finding State Laws on taxes.

This book is a very valuable guide for any person who has accepted the responsibility of serving as an executor of an estate or trustee to a personal trust. It explains the functions and possible advantages of wills and trusts. It explains the meaning, duties and responsibilities of the executor or trustee with general guidance on steps required to correctly perform these duties. This book makes these common but misunderstood instruments and job positions more easily understood. It provides an excellent starting point for laymen who want, or more likely, need to understand the duties that have been thrust upon them. The authors explanations are jargon free and clear. The book is concise with good review sections included.
I used four stars due the structural use of the question and answer format. I found it a bit contrived and distracting. This was a personal judgement. Others might find this a very helpful structure. Overall the material in this book was very helpful in alerting me to the opportunities, potential pitfalls and duties within this very personal area of the law. I wish I had read this book ten years ago.

The book was written and presented In an easy to understand format. I liked the question and answer concept. It is obvious that the authors have a clear understanding of trusts.
"Dynamite Trustee" by Tom and Jeanne Emanuel is going to be of immense help to anyone who needs a detailed working knowledge of what's involved in being a trustee. The facts, the traps, stuff your lawyer should tell you (but might not).
While the topic is not light reading, they've done a superb job in sharing the details via an interview format. Tom asks the questions, Jeanne answers them. I can think of no better way to convey this information.
As a real estate broker for over 30 years, I’ve seen firsthand the trouble (and expense) caused by the Probate system. The good news is that with proper planning it can be avoid.
How to be a Dynamite Trustee is an easy-to-read guide to the overall process of being a trustee. It clearly follows the reasons and process of the living trust and gives good solid advice to the reader. Jeanne does a good job of explaining the law in a clear understandable way without the legal mumbo jumbo that makes my head hurt. Tom’s questions and recap work as a good sounding board for the average Joe (like me).
If you’ve taken the time and expense to have a living will drawn up, my suggestion would be to give this book to the person you’ve named as a successor trustee. It helps make sense of the process without overwhelming the reader.
